01Legal Framework and Elements of the Crime
Pasal 473 Ayat (1) of the KUHP 2023 defines rape as any person who uses violence or threat of violence to compel another person to have sexual intercourse. The penalty is imprisonment for a maximum of 12 years. This is a fundamental shift from the old Pasal 285 WvS, which restricted victims to women and required penetration to be penile-vaginal. The new code is gender-neutral in both perpetrator and victim, meaning male-on-male, female-on-male, and any other combination is now covered.
Pasal 473 Ayat (2) expands what counts as rape to include: intercourse obtained by impersonating the victim's spouse (consent obtained by deception), intercourse with a child (statutory rape, where consent is legally irrelevant), intercourse with someone who is unconscious or incapacitated, and intercourse with a person who has an intellectual or mental disability obtained through exploitation.
Pasal 473 Ayat (3) further extends the definition to acts previously categorized merely as "perbuatan cabul" (indecent acts). These now include: insertion of genitalia into the anus or mouth of another person, causing another person's genitalia to enter one's own anus or mouth, and insertion of non-genital body parts or objects into the genital or anal orifice. This is a high-yield expansion because the old code would only classify penile-vaginal penetration as rape. Everything else would fall under the lesser charge of indecent assault.
Pasal 473 Ayat (6) recognizes marital rape for the first time in Indonesian criminal law. However, it is classified as a delik aduan absolut (absolute complaint offense), meaning prosecution can only proceed if the victim (spouse) files a formal complaint. This contrasts with the general rape provision in Ayat (1), which is a delik biasa (ordinary offense) and can be prosecuted by the state without the victim's complaint.
Aggravating factors include: the assault resulting in severe injury (luka berat, maximum 15 years), the victim's death (penalty increased by one-third), the victim being a biological child, stepchild, or ward (penalty increased by one-third), and commission during emergencies, disasters, conflict, or war, or committed in a group (penalty increased by one-third).
The statute of limitations for rape under the KUHP, given the maximum penalty of 12 years, is 12 years from the date of the offense.

Rape by deception (spousal impersonation) | Pasal 473 (2)(a) | Consent obtained by fraud | 12 years |
Statutory rape (child victim) | Pasal 473 (2)(b) | Intercourse with a minor; consent is irrelevant | 3-15 years |

Expanded penetration (oral, anal, objects) | Pasal 473 (3) | Non-vaginal penetration by force | 12 years |
Marital rape | Pasal 473 (6) | Within marriage; delik aduan absolut | 12 years |
The distinction between delik biasa and delik aduan is a classic exam trap. All forms of rape under Pasal 473 are delik biasa except marital rape (Ayat 6), which requires a formal victim complaint.

Visum et Repertum
VeR is a legal document with the evidentiary status of an expert opinion (keterangan ahli) under Indonesian procedural law. It can only be issued upon a written request from law enforcement (police, prosecutor, or judge). A physician cannot refuse this request; refusal is a criminal offense.
The standard VeR structure consists of five parts:
Pro Justitia (heading indicating the document is for the interest of justice), Pendahuluan (introduction with date, time, requesting authority, physician identity, and patient identity), Pemberitaan/Hasil Pemeriksaan (the objective findings from examination), Kesimpulan (the physician's expert conclusion based on findings), and Penutup (closing statement, oath, and signature).
The conclusion section is the most testable. The physician must address two core questions:
First, signs of recent intercourse (tanda persetubuhan): the presence of hymenal tears (recent or healed), spermatozoa on microscopy, or seminal fluid. The physician states whether findings are "consistent with" (sesuai dengan) penetration but never states that "rape occurred," because consent is a legal determination, not a medical one.
Second, signs of violence (tanda kekerasan): the presence of bruises, abrasions, lacerations, defense injuries, bite marks, or ligature marks. These suggest force was used but, again, do not prove rape in themselves.
Hymenal Examination
The hymen is examined using the clock-face position system with the patient in the lithotomy position. The 12 o'clock position is anterior (toward the clitoris/urethra), and the 6 o'clock position is posterior (toward the anus).
Findings are classified as:
Recent tears show bleeding edges, redness, and swelling. They are typically found at the 5, 6, and 7 o'clock positions (posterior hymen), because this region is anatomically thinnest and experiences the greatest force during penetration.
Healed tears (old lacerations) appear as notches or clefts that extend to the base of the hymen (complete tears) or partway (incomplete tears). The edges are smooth and non-bleeding.
A tear is considered complete when it extends all the way to the hymenal base (insertion point to the vaginal wall). This carries greater evidentiary weight for penetration.
Crucially, the absence of hymenal injury does not exclude penetration. An elastic or redundant hymen may accommodate penetration without tearing. Similarly, digital penetration or use of small objects may not cause visible damage.
Evidence Collection
Vaginal swabs should be collected from the posterior fornix, which is the dependent pooling site for seminal fluid. Spermatozoa can be detected on wet-mount microscopy for up to 72 hours, though motile spermatozoa are typically only present within the first 6-12 hours. In the cervical canal, spermatozoa may persist for up to 5-7 days.
Acid phosphatase is a marker for seminal fluid and can be detected even in the absence of spermatozoa (e.g., azoospermic or vasectomized perpetrator). Prostate-specific antigen (PSA / P30) is another confirmatory marker for seminal fluid.
Wood's lamp (UV light) examination of the skin and clothing can reveal fluorescent staining suggestive of seminal fluid, though this has limited accuracy and many substances can cause false positives.
DNA analysis through STR (Short Tandem Repeat) profiling from biological specimens is the gold standard for perpetrator identification.

Note that in Indonesia, the abortion provision under Pasal 463 Ayat (2) KUHP 2023 permits abortion for victims of rape or other sexual violence crimes, provided the gestational age does not exceed 14 weeks and there is a medical emergency indication.
The physician's duty includes chain of custody documentation for all collected specimens. Every item of evidence must be labeled, sealed, signed, and transferred directly to law enforcement with a written record of each handoff.

06Traps and High-Yield Pearls
The number one trap on this topic is confusing the physician's role with the court's role. Students often believe the doctor "proves" rape. The physician can only state that findings are consistent or inconsistent with penetration and/or violence. Whether the act constituted rape (i.e., whether consent was absent) is determined by the court, not the doctor. The VeR conclusion should never state "korban diperkosa" (the victim was raped).
A second common error is assuming that a normal hymen excludes penetration. Elastic hymens, partial penetration, and digital/object penetration may leave no visible trace. The absence of injury is not proof that an assault did not occur.
Third, students frequently forget the time-sensitive nature of evidence. Asking a vignette about what to do with a rape victim who presents more than 72 hours later is a classic setup. While swabs may still be collected (especially cervical), the yield decreases. The emphasis shifts to documentation of any remaining injuries, photography, STI testing, pregnancy testing, and psychosocial support.
Fourth, the delik biasa vs. delik aduan distinction for marital rape is a high-yield legal pearl. All other forms of rape under Pasal 473 proceed automatically once reported to police. Marital rape prosecution requires the spouse-victim to file a formal complaint, and the victim retains the right to withdraw that complaint.
Finally, regarding the new KUHP 2023 expansion: any vignette describing forced oral or anal penetration, or forced insertion of objects/fingers into the vagina or anus, now falls under the full rape provision (Pasal 473 Ayat 3), not the lesser indecent assault charge. This is the core competency being tested: recognizing that the legal definition of rape has been broadened, and the forensic physician must document findings in a manner that addresses every element of this expanded definition.
