01Regulatory Framework and Rationale
The exclusions from BPJS Kesehatan coverage are regulated under Presidential Regulation (Perpres) No. 82 of 2018 on National Health Insurance. Perpres No. 59 of 2024 serves as the third amendment to this regulation. The governing article is Pasal 52 ayat (1), which enumerates 21 categories of healthcare services that fall outside the JKN benefit package.
The underlying logic of these exclusions follows several testable principles:
Subsidiarity of coverage. If a healthcare service is already guaranteed by another program (e.g., workplace accident insurance under BPJS Ketenagakerjaan, traffic accident insurance under Jasa Raharja, or military/police health programs), JKN does not duplicate payment. The exam tests your ability to assign the correct payer to the correct scenario.
Medical indication requirement. JKN only covers services that have a clear medical indication (indikasi medis). Aesthetic procedures, orthodontics for cosmetic purposes, and infertility treatments fall outside the "basic health needs" (kebutuhan dasar kesehatan) framework.
Procedural compliance. Even medically necessary services become non-covered if they are obtained outside the proper referral pathway. A self-requested referral (rujukan atas permintaan sendiri) or treatment at a non-partnered facility (except in genuine emergencies) is not reimbursed.

03Key Amendment Under Perpres 59/2024
A testable change introduced by Perpres 59/2024 involves the treatment of victims of criminal acts. Under the original Perpres 82/2018, healthcare for victims of criminal violence was excluded broadly, but Perpres 59/2024 amended Pasal 52 ayat (1) huruf (r) so that these services are excluded only when another designated government funding scheme is already providing coverage. This means that if no other scheme has guaranteed coverage for a crime victim, the exclusion is not automatic, and JKN may bear the cost, provided all other medical indication and procedural requirements are met.
This is a critical nuance: the exclusion is conditional, not absolute, following the 2024 amendment.

The old Class 1, 2, and 3 system has been officially replaced starting 2026 by KRIS, under Perpres No. 59 of 2024, with the goal of eliminating service discrimination based on contribution tier. Full national implementation began in 2026 after hospitals were required to meet 12 technical facility criteria by mid-2025.
For the exam, understand that KRIS does not change which services are excluded. The 21 exclusions in Pasal 52 remain identical. What KRIS changes is the standard of the room and facility for covered inpatient services. A participant who desires a room above the KRIS standard must pay the difference out of pocket or through supplementary private insurance.
05The Referral Pathway (Sistem Rujukan Berjenjang)
Understanding the referral system is essential because violation of the referral pathway is itself an exclusion category (exclusion no. 1 on the list).
Level 1 (FKTP)
Facility
Puskesmas, private clinic, or family doctor registered with BPJS
Role
Gatekeeper; handles 144+ diagnoses per SKDI 2021; issues referral if indicated
Level 2 (FKRTL)
Facility
Hospital or specialist outpatient clinic partnered with BPJS
Role
Receives referred patients; provides specialist and subspecialist care
Emergency exception
Facility
Any facility, including non-partnered ones
Role
Patient must be stabilized; costs covered by BPJS if genuine emergency criteria are met
Level | Facility | Role |
|---|---|---|
Level 1 (FKTP) | Puskesmas, private clinic, or family doctor registered with BPJS | Gatekeeper; handles 144+ diagnoses per SKDI 2021; issues referral if indicated |
Level 2 (FKRTL) | Hospital or specialist outpatient clinic partnered with BPJS | Receives referred patients; provides specialist and subspecialist care |
Emergency exception | Any facility, including non-partnered ones | Patient must be stabilized; costs covered by BPJS if genuine emergency criteria are met |
If a patient goes directly to a hospital without a referral from the FKTP and the condition is not an emergency, the cost is not covered by JKN. The vignette will test whether the patient's actions were procedurally correct or whether the situation qualifies as a genuine emergency exception.
06Distinguishing JKN from Other Insurance Programs
This is a high-yield area because exam questions often present a scenario where the correct answer is "not covered by JKN" because the appropriate payer is a different program entirely.
Factory worker injured by a machine at work
Correct Payer
BPJS Ketenagakerjaan (Jaminan Kecelakaan Kerja / JKK)
Why NOT JKN
Occupational injury is covered by JKK, not JKN
Motorcyclist injured in a traffic accident
Correct Payer
Jasa Raharja (PT Jasa Raharja, mandatory traffic accident insurance)
Why NOT JKN
Traffic accident coverage is handled by Jasa Raharja up to the entitled amount
Active military officer needing surgery
Correct Payer
Ministry of Defense / TNI healthcare program
Why NOT JKN
Military personnel have their own health service system
Disease outbreak (KLB) such as a declared epidemic
Correct Payer
Government disaster/outbreak response budget
Why NOT JKN
Outbreak management is a public health function funded separately
Worker laid off (PHK)
Correct Payer
JKN (BPJS Kesehatan) remains active for up to 6 months post-termination without paying contributions
Why NOT JKN
This IS still covered; the exam tests that you know terminated workers retain JKN rights temporarily
Scenario | Correct Payer | Why NOT JKN |
|---|---|---|
Factory worker injured by a machine at work | BPJS Ketenagakerjaan (Jaminan Kecelakaan Kerja / JKK) | Occupational injury is covered by JKK, not JKN |
Motorcyclist injured in a traffic accident | Jasa Raharja (PT Jasa Raharja, mandatory traffic accident insurance) | Traffic accident coverage is handled by Jasa Raharja up to the entitled amount |
Active military officer needing surgery | Ministry of Defense / TNI healthcare program | Military personnel have their own health service system |
Disease outbreak (KLB) such as a declared epidemic | Government disaster/outbreak response budget | Outbreak management is a public health function funded separately |
Worker laid off (PHK) | JKN (BPJS Kesehatan) remains active for up to 6 months post-termination without paying contributions | This IS still covered; the exam tests that you know terminated workers retain JKN rights temporarily |
07Drugs and Formulary Limitations
Even when a service is covered by JKN, not all medications are reimbursable. Medications and services that are not listed in the national benefits package or the Formularium Nasional (Fornas) are not covered. Fornas is the national drug formulary that dictates which pharmaceuticals BPJS will pay for. If a physician prescribes a drug outside Fornas, the patient bears the cost.
For the exam, the testable principle is: covered disease + non-Fornas drug = patient pays out of pocket for the drug. The treatment itself remains covered, but the choice of medication must align with the formulary.
08Distractors
"JKN covers all emergencies at any hospital"
Why It Seems Correct
True for the emergency itself, but students forget that non-emergency services at non-partnered facilities are excluded
Key Discriminator
Check whether the vignette describes a genuine emergency or a planned visit to an uncontracted hospital
"Cosmetic surgery is never covered"
Why It Seems Correct
Generally true, but reconstructive surgery after trauma or congenital defect correction IS covered because it has a medical indication
Key Discriminator
Look for medical indication vs. aesthetic purpose in the stem
"Infertility treatment is covered because it is a medical condition"
Why It Seems Correct
Infertility is a recognized medical condition, but its treatment is explicitly listed as an exclusion under Pasal 52
Key Discriminator
Memorize: infertility treatment is among the named exclusions regardless of diagnosis
"Workplace injury is always covered by JKN"
Why It Seems Correct
JKN is the national health insurance, but workplace injuries fall under JKK through BPJS Ketenagakerjaan
Key Discriminator
Identify the setting: "at work" or "during employment duties" redirects to JKK
"Alternative medicine is covered if the patient requests it"
Why It Seems Correct
Patient preference does not create coverage; the therapy must be validated through health technology assessment
Key Discriminator
The phrase "pengobatan komplementer/alternatif/tradisional yang belum dinyatakan efektif" is a direct exclusion trigger
"Crime victims always pay out of pocket"
Why It Seems Correct
Under the 2024 amendment, coverage exclusion applies only when another government scheme is already paying
Key Discriminator
If the vignette states no other scheme covers the victim, JKN may apply
Exam Distractor | Why It Seems Correct | Key Discriminator |
|---|---|---|
"JKN covers all emergencies at any hospital" | True for the emergency itself, but students forget that non-emergency services at non-partnered facilities are excluded | Check whether the vignette describes a genuine emergency or a planned visit to an uncontracted hospital |

09Traps and High-Yield Pearls
The most common way students get questions on this topic wrong is by confusing the payer. A vignette will describe a patient with a legitimate medical condition, and the instinct is to say JKN covers it. But the question is not asking whether the disease is real. The question is asking who pays. If the injury occurred at work, the answer shifts to BPJS Ketenagakerjaan. If it occurred in a traffic accident, the answer shifts to Jasa Raharja. Students who fail to identify the correct insurance program in the stem will select JKN by default and lose the point.
A second trap involves the referral pathway. A patient who skips the Puskesmas/FKTP and goes directly to a hospital for a non-emergency condition will be told the cost is not covered. The exam tests whether you recognize that the procedural violation, not the medical condition, is the reason for non-coverage.
A third trap relates to cosmetic vs. reconstructive surgery. A woman requesting rhinoplasty for appearance is not covered. A patient with a nasal fracture from trauma requiring surgical repair is covered. Both involve surgery on the nose; the discriminator is the indication. Look for the word "estetik" (aesthetic) vs. "indikasi medis" (medical indication) in the vignette.
Finally, know that the KRIS reform does not expand the benefit package. It standardizes inpatient room quality. Students who confuse KRIS with an expansion of covered services will incorrectly assume that previously excluded services are now included. The 21 exclusions remain unchanged. KRIS changes how covered services are delivered, not which services are covered.
